1. Wholesale accounts

Access to nutritionalinnovations.net (the "Site") is limited to licensed pharmacies, dispensers, and clinical practices approved by Nutritional Innovations. Approval is at our discretion. We may suspend or terminate any account at any time.

You warrant that all licensing, DEA, NPI, resale certificate, and tax information you submit is true, current, and complete. You must notify us within 30 days of any change.

2. Orders, pricing, availability

Wholesale prices are displayed on the Site once your account is approved. Prices are subject to change without notice. Product availability is not guaranteed until an order is confirmed by us. We reserve the right to cancel any order, refund payment, and correct pricing errors.

Orders are considered placed when submitted via the Site. Confirmation is sent by email. Ownership passes when goods are handed to the carrier; risk of loss transfers per the carrier's policy.

3. Payment terms

Approved accounts may qualify for Net-30 or Net-60 terms at our discretion. Otherwise, prepay or credit-card payment is required at time of order. Late payments accrue interest at 1.5% per month, or the maximum permitted by law, whichever is lower.

4. Product use and resale

All products sold via the Site are intended for resale by licensed pharmacies to their patients, or for professional use in clinical settings. You may not repackage, relabel, or misrepresent products.

You are solely responsible for compliance with all applicable federal, state, and local laws in your jurisdiction, including but not limited to controlled-substance handling, DSCSA traceability, and state pharmacy board regulations.

5. Health claims disclaimer

Products sold are dietary supplements. Statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

6. Returns and refunds

7. Limitation of liability

To the maximum extent allowed by law, Nutritional Innovations' total liability for any claim arising out of or related to the Site or products purchased is limited to the amount paid by you for the specific order at issue. In no event will we be liable for indirect, consequential, incidental, special, or punitive damages.

8. Intellectual property

All content on the Site — logos, product names, images, copy — is owned by Nutritional Innovations or its licensors. You may not reproduce, distribute, or create derivative works without written consent.

9. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Exclusive venue for any dispute is the state or federal courts located in Erie County, Pennsylvania.

10. Changes to these Terms

We may update these Terms at any time by posting a revised version on the Site. Continued use after posting constitutes acceptance.

1. What we collect

We collect information you provide when applying for a wholesale account and placing orders:

• Business identity: company name, pharmacy type, state license number, DEA registration, NPI, tax ID / EIN, resale certificate
• Contact information: names, emails, phone numbers, billing and shipping addresses
• Transaction data: orders placed, invoices, payments
• Site usage: pages visited, browser type, referring URL, IP address

Payment card details are handled by our payment processor (currently unassigned; historically Stripe) and are not stored on our servers.

2. How we use it

• Verify your eligibility for wholesale purchasing (licensing checks)
• Process and fulfill orders, invoices, and returns
• Communicate with you about your account, orders, and products
• Comply with DSCSA, DEA, state pharmacy board, and tax reporting requirements
• Detect and prevent fraud

3. Who we share it with

We share information only with parties needed to run the business:

• Payment processors (for card payments)
• Shipping carriers (name, address, phone for delivery)
• Accounting and ERP systems (NetSuite) for invoicing
• Regulators upon lawful request

We do not sell your information.

4. Data retention

We retain account and transaction records as required by federal and state pharmacy, tax, and business regulations — typically 7 years. You can request deletion of non-required data by emailing us; regulatory-required records will remain.

5. Security

We use industry-standard controls including HTTPS/TLS in transit, encrypted database storage, and least-privilege access. No system is perfectly secure — you agree to notify us immediately at orders@nutritionalinnovations.net if you suspect account compromise.

6. Your choices

You may update your business or contact info at any time from your account. You may opt out of non-transactional email at any time; transactional emails (order confirmations, shipment notices, invoicing) are necessary for the service.

Dietary supplements, not drugs

Products sold by Nutritional Innovations are dietary supplements, regulated under the Dietary Supplement Health and Education Act of 1994 (DSHEA). They are not FDA-approved drugs. They are not intended as substitutes for professional medical advice, diagnosis, or treatment.

No medical claims

Any structure/function claims made about our products describe how a supplement supports normal body function — they are not claims of disease prevention, treatment, or cure. Individual results vary. Consult a qualified healthcare provider before starting any supplement, especially if pregnant, nursing, taking medication, or managing a chronic condition.

Wholesale sale to licensed pharmacies

Products on this site are sold wholesale to licensed pharmacies, dispensers, and clinical practices for resale or professional use. It is the purchaser's responsibility to comply with all federal, state, and local laws governing the sale and dispensing of dietary supplements.

Manufacturing partners

Nutritional Innovations is a distributor — we do not manufacture supplements ourselves. Instead we partner with FDA-registered contract manufacturers in the United States that operate under current Good Manufacturing Practices (cGMP) as codified in 21 CFR Part 111.

Our private-label microbiome line (Ultra Spore Biotic, Ultra Pre Powder, GastroGuard, FloraRestore, FemFlora Balance) is manufactured in partnership with Microbiome Labs. Our broader vitamin and mineral catalog is produced under strict cGMP controls by FDA-registered facilities in the United States.

Quality standards our partners follow

• Identity, purity, strength, and composition testing on every lot
• Documented raw material specifications and vendor qualification

Certificates of Analysis (CoA)

A Certificate of Analysis documents the results of testing for a specific manufactured lot. We can provide a CoA for any product lot shipped to your pharmacy.

To request a CoA, email quality@nutritionalinnovations.net with the product name and lot number (printed on the bottle or shipping documentation). We aim to respond within 3 business days.

Reporting a quality concern

If you receive a product that appears damaged, mislabeled, or otherwise fails to meet expectations, contact quality@nutritionalinnovations.net immediately. Adverse events should also be reported to FDA MedWatch at fda.gov/safety/medwatch.
